Common Questions

Frequently Asked Questions

How can I appeal an ATO decision?
If you disagree with an ATO decision, you can lodge an objection within the required timeframe (generally 60 days for income tax assessments). If the objection is unsuccessful, you can appeal to the Administrative Appeals Tribunal or the Federal Court. At Tributum Law, we handle every stage of this process, from drafting a compelling objection to full litigation representation.
What structures are best for wealth protection?
The right structure depends on your circumstances, but discretionary family trusts are widely used because they offer flexibility in income distribution, potential CGT concessions, and a degree of asset protection. Hybrid trusts, unit trusts, and corporate trustees each serve specific purposes. We assess your entire financial position and goals before recommending any structure.
Why is estate planning crucial?
Without proper estate planning, your assets may not reach the intended beneficiaries, and your estate could face significant tax liabilities. Testamentary trusts can provide substantial tax savings for minor beneficiaries and offer protection from family law claims. We work with you to ensure your will, powers of attorney, and trust structures form a cohesive, tax-effective plan.
What is the difference between a discretionary trust and a unit trust?
A discretionary trust gives the trustee full discretion over how income and capital are distributed among beneficiaries, making it highly flexible for family groups. A unit trust has fixed ownership similar to a company with shares, making it more suitable for joint ventures. Both have distinct tax implications, and we help you choose the right structure for your goals.
Can you assist with international tax compliance?
Yes. We advise on cross-border tax issues including foreign income, controlled foreign companies, transfer pricing, and the tax treatment of foreign trusts and investments. Mathew Brittingham has particular expertise in international tax matters and regularly advises clients with global structures and obligations.
How do your fixed-fee engagements work?
After our initial consultation, we provide a clear written proposal setting out the scope of work and a fixed fee. You know exactly what you will pay before work begins, with no surprise invoices. Our clients consistently tell us this transparency is one of the things they value most about working with us.
